The Impact of the Ratification on Convention Abolishing the Requirement of Legalisation for Foreign Public Documents

Pada tanggal 4 Januari 2021, Pemerintah Indonesia telah mengeluarkan Peraturan Presiden Nomor 2 Tahun 2021 tentang Pengesahan Convention Abolishing The Requirement Of Legalisation For Foreign Public Documents (Konvensi Penghapusan Persyaratan Legalisasi Terhadap Dokumen Publik Asing) (“PP 2/21“).

On January 4 2020, the Government of Indonesia have issued the President Regulation No. 2 of 2021 on the Ratification on Convention Abolishing the Requirement of Legalisation for Foreign Public Documents (“PR 2/21“).

Dampak

Indonesia kini telah menjadi negara pihak (state party) pada Konvensi Apostille.
Indonesia menghapuskan proses legalisasi wajib yang terkait dengan penggunaan dokumen publik tertentu yang berasal dari atau yang digunakan di negara pihak lainnya dari Konvensi Apostille.

The Impact

Indonesia has now become a state party to the Apostille Convention
Indonesia now abolished the mandatory legalization processes involved in the utilization of certain public documents that originate from or which will be used within other state parties to the Apostille Convention.

Lingkupan Dokumen Publik

Penghapusan persyaratan legalisasi yang ditetapkan dalam Konvensi Apostille berlaku secara untuk dokumen publik yang digunakan di wilayah negara peserta (contracting state) dan harus dibuat di wilayah negara peserta lainnya, yang mana jenisnya dapat dikategorikan sebagai berikut:
- Dokumen yang berasal dari otoritas atau pejabat yang terkait dengan pengadilan atau pengadilan negara, termasuk yang berasal dari jaksa penuntut umum, panitera pengadilan atau jurusita;
- Dokumen administratif;
- Dokumen yang dikeluarkan oleh notaris; dan/atau
- Sertifikat resmi yang dilekatkan pada dokumen yang ditandatangani oleh orang-orang dalam kewenangan perdatanya.
Konvensi Apostille membatasi ruang lingkup dokumen yaitu:
- Dokumen yang ditandatangani oleh pejabat diplomatik/konsuler; atau
- Dokumen administratif yang berhubungan langsung dengan kegiatan komersial atau bea cukai

The Scope of the Public Documents

The abolishment of the legalization requirement stipulated under the Apostille Convention applies to public documents that are executed within the territory of a contracting state and which have to be produced within the territory of another contracting state, the type of documents are as follows:
- Documents emanating from an authority or an official connected with the courts or tribunals of the state, including those emanating from a public prosecutor, a clerk of a court or a process server;
- Administrative documents;
- Notarial acts; and/or
- Official certificates that are placed on documents signed by persons in a private capacity.
The Apostille Convention limits the scope of public documents to exclude the following documents:
- Documents that are executed by diplomatic or consular agents; or
- Administrative documents that deal directly with commercial or customs operations.

Deklarasi (Persyaratan) Terhadap Konvensi

Pemerintah Republik Indonesia terikat terhadap ketentuan Pasal 1 tentangruang lingkup dokumen publik dalam Konvensi dengan pernyataan bahwa sepanjang dokumen yang diterbitkan oleh kejaksaan sebagai lembaga penuntutan di Republik Indonesia, tidak termasuk dalam dokumen publik yang dihapuskan persyaratan legalisasinya sebagaimana diatur dalam Konvensi.

Declaration (Reservation) to Convention

The Government of the Republic of Indonesia is bound by the provisions of Article 1 concerning the scope of public documents in the Convention by stating that as long as the documents issued by the prosecutor’s office as a prosecuting institution in the Republic of Indonesia are not included in public documents whose legal requirements are abolished as regulated in the Convention.
