By way of background a HGU is a right to cultivate a land which owned directly by the State for a agriculture, fisheries or livestock and can only be granted to Indonesian citizens or legal entities which established in accordance with Indonesian law.

Sebagai latar belakang HGU adalah suatu hak untuk menggunakan suatu lahan yang dimiliki oleh Negara untuk suatu usaha di bidang pertanian, perikanan atau peternakan dan hanya dapat diberikan kepada warga negara Indoensia atau badan hukum yang didirikan sesuai dengan Hukum Indonesia.

HGU Land Status
The Agrarian Reg 7/2017 stipulates a more comprehensive approach for types of land which are under the HGU regime, HGU can be obtained by applicants for lands that falls under one of the status categories as set out below:
- State Land;
- Land Rights;
- Traditional Community Land Rights;
- State Forestry Areas;
- Right to Manage Transmigration.
Securing the HGU
Applicant must first be in possession and control of the land which being applied for and should be proven by data in accordance with the prevailing laws and regulations. The procedure is as follows:

Status HGU
Permen 7/2017 menjelaskan suatu langkah lebih komprehensif untuk tipe-tipe dari tanah yang berada dalam rezim HGU, HGU dapat didapatkan oleh pemohon untuk tanah-tanah yang termasuk dalam kategori dibawah ini :
- Tanah Negara;
- Tanah Hak;
- Tanah Ulayat;
- Kawasan Hutan Negara;
- Hak Pengelolaan Transmigrasi.
Memperoleh HGU
Pertama-tama pemohon harus menguasai dan mengendalikan tanah yang akan dimohonkan dan harus dibuktikan dengan data-data sesuai dengan hukum yang berlaku, prosedur untuk hal tersebut adalah sebagai berikut:

Land Measurement –> Right Submission –> Land Assessment –> Land Right Determination –> Registration of HGU.
HGU will remain valid for up to a maximum period of 35 years and can be extended for another 25 years. After the HGU is expired, HGU holder may renew their HGU for a similar area of land for a maximum period of 35 years.

Pengukuran Bidang Tanah –> Permohonan Hak –> Pemeriksaan tanah –> Penetapan Hak –> Pendaftaran Hak.
HGU akan berlaku sampai dengan maksimal 35 tahun dan dapat diperpanjang untuk 25 tahun. Setelah HGU habis masanya, pemilik HGU dapat memperbarui HGU mereka untuk suatu area tanah yang serupa maksimal selama 35 tahun.
