Pursuant to the Constitutional Court Verdict No. 22/PUU-XV/2017 to the Article 7 of the Law No. 1 of 1974 (“Marriage Law“), the government decided to further amend the Marriage Law with Law No. 16 of 2019 (“Law 16“).
Overview
Minimum Marriage Age
As have been explained in the above, the previous minimum marriage age for Man – 19 years and woman – 16 years, is changed with Law 16 to become :
“Marriage is only permitted if men and women have reached the age of 19 (nineteen) years“
Deviation to the Minimum Marriage Age
In the event that there will be a deviation to the minimum marriage age the parents of the man/woman may apply for a dispensation to Court with a “very urgent” reason supported by an adequate supporting evidence. the granting of the said dispensation by the Court shall hear the opinion of the soon-to-be husband and wife who will conduct the marriage.

Berdasarkan Putusan Mahkamah Konstitusi No. 22 / PUU-XV / 2017 dengan Pasal 7 UU No. 1 tahun 1974 (“UU Perkawinan“), pemerintah memutuskan untuk lebih lanjut mengubah UU Perkawinan dengan UU No. 16 Tahun 2019 (“UU 16“).

Usia Minimum Perkawinan
Seperti yang telah dijelaskan di atas, pada Pasal 7 UU Perkawinan , usia pernikahan minimum sebelumnya untuk Pria adalah 19 tahun dan wanita adalah 16 tahun, diubah oleh UU 16 menjadi:
“Perkawinan hanya diizinkan jika pria dan wanita sudah mencapai usia 19 (sembilan belas) tahun“
Penyimpangan terhadap Usia Perkawinan Minimum
Dalam hal terjadi penyimpangan pada usia minimum perkawinan, orang tua pria / wanita tersebut dapat mengajukan penyimpangan ke Pengadilan dengan alasan “sangat mendesak” yang didukung oleh bukti pendukung yang memadai. pemberian penyimpangan tersebut oleh Pengadilan akan mendengarkan pendapat kedua belah pihak calon suami dan calon istri yang akan melaksanakan perkawinan.
