Pendahuluan

Peraturan Presiden (Perpres) Nomor 93 Tahun 2024 tentang Lembaga Administrasi Negara (LAN) diterbitkan sebagai implementasi dari ketentuan Pasal 26 ayat (5) Undang-Undang Nomor 20 Tahun 2023 tentang Aparatur Sipil Negara (ASN). Pengangkatan Pejabat

Kepala LAN
- Pengangkatan: Kepala LAN diangkat oleh Presiden atas usulan dari Menteri yang menyelenggarakan urusan pemerintahan di bidang aparatur negara. Pengangkatan ini didasarkan pada pertimbangan kompetensi, integritas, dan pengalaman di bidang administrasi negara.
- Masa Jabatan: Masa jabatan Kepala LAN biasanya mengikuti ketentuan yang berlaku untuk pejabat setingkat eselon I, kecuali ditentukan lain oleh Presiden.
Deputi
- Pengangkatan: Deputi di LAN diangkat oleh Presiden berdasarkan usulan dari Kepala LAN yang diajukan melalui Menteri. Pengangkatan Deputi dilakukan dengan mempertimbangkan keahlian khusus dalam bidang yang relevan dengan tugas Deputi tersebut.

Sekretaris Utama
- Pengangkatan: Sekretaris Utama diangkat oleh Presiden atas usulan Kepala LAN melalui Menteri. Jabatan ini ditujukan untuk seseorang yang memiliki kemampuan manajerial dan administrasi yang kuat.
- Masa Jabatan: Sama dengan Deputi, Sekretaris Utama juga memiliki masa jabatan yang mengikuti ketentuan untuk pejabat eselon II atau sesuai dengan aturan yang berlaku.

Pemberhentian Pejabat

Kepala LAN
- Pemberhentian: Kepala LAN dapat diberhentikan oleh Presiden atas dasar:
  - Berakhirnya masa jabatan;
  - Permintaan sendiri;
  - Tindakan yang melanggar hukum atau kode etik;
  - Penilaian kinerja yang tidak memuaskan;
  - Alasan lain yang dianggap perlu oleh Presiden.
- Prosedur Pemberhentian: Pemberhentian ini dilakukan melalui Keputusan Presiden setelah mempertimbangkan masukan dari Menteri.
Deputi dan Sekretaris Utama
- Pemberhentian: Deputi dan Sekretaris Utama dapat diberhentikan oleh Presiden atas dasar yang serupa dengan Kepala LAN, yaitu:
  - Berakhirnya masa jabatan;
  - Permintaan sendiri;
  - Pelanggaran hukum atau kode etik;
